Please read these Terms & Conditions carefully and in their entirety before using courses.myanichol.com (hereinafter referred to as the “Site”). The Site and its content are owned by Sorcha Isibeal Coaching.

PURPOSE: These Terms & Conditions are here to clearly explain, outline, and layout the rules, terms, and conditions of using, viewing, and/or browsing the Site and/or purchasing or downloading any course, program, service, or product offered on or by us or the Site.
IMPORTANT NOTES:

These Terms & Conditions contain an Arbitration Clause and require you to dispute or resolve any claim with us through Arbitration. By agreeing to these Terms & Conditions, you agree to the Arbitration Clause in Paragraph No. 17 and voluntarily waive your right to a jury trial.

“You” or “Your” means the user, customer, or viewer of the Site.

You grant us a license to use your comments or submissions in any way we see fit, as it relates to our business purposes.

10. Purchase & Access Terms:
During the course of your use, Purchase, and/or Download from the Site, Courses, Coaching Services, and/or Products, you agree and understand that you cannot distribute, copy, forward, and/or share information prohibited by these Terms & Conditions. You also agree and understand that you are to take all necessary steps to make sure that you do not inadvertently share or distribute said materials, including, but not limited to, protecting your password (if any) to the Site to access your Purchase or Download. 11. Sharing the Site & Its Content:

Any and all current or past-client testimonials, statements, or examples used by us are simply that: examples. They are not guarantees that you will also experience or receive the same results. Each client and his/her circumstances are unique and nothing shall be interpreted as a guarantee that you will experience the same results as another client of ours.

13. DISCLAIMER - No Warrantees, Guarantees, or Representations Are Being Made:
We do not offer any warranties, of any variety, regarding the Site, Courses, Coaching Services, and/or Products, and/or your Purchase or Download, in any way. The Site, Courses, Coaching Services, and/or Products, and/or your Purchases or Downloads are offered “AS IS” and without warranties of any kind, neither express nor implied, to the extent permitted by law.

14. Your Release of Us:
By using the Site or Purchasing, Downloading, or using Sorcha Isibeal Coaching’s Courses, Memberships, Coaching Services, and Products, you agree to release, forgive, and forever discharge Sorcha Isibeal Coaching, from any and all claims, suits, actions, charges, demands, liabilities, damages, judgments, and/or costs, whether known or unknown, both legal and equitable in any manner.

15. Errors & Omissions:
Every effort is made to provide up-to-date accurate information both on the Site and through our services. However, due to the complexity of the issues we cover, Sorcha Isibeal Coaching does not and cannot warrant, represent, or guarantee that such information is free from errors, accurate, or up-to-date at all times. You should do your due diligence, research, or consult with a professional to ensure that all information you receive, act upon, or rely on from this Site and/or from our services is accurate and up-to-date.

16. Our Refund Policy:
We will do everything within our ability (and within reason) to ensure your satisfaction. Refunds will not be issued for products already purchased.

If you wish to cancel and refund your Coaching Program (8 weeks or 6 months options) you must contact Sorcha within 7 days of the first payment to receive a full refund, at info@sorcha-lifecoach.co.uk.

Please Note: No refunds, credits or transfers are available for no-shows. It is your responsibility as a client to show up in the sessions and in the homework, as your end result will be determined by your own efforts.

In exceptional circumstances, such as illness or unavailability due to bereavement or other commitments, inappropriate behaviour by the client, actual or potential conflict of interest, or other reasons, Sorcha can decide to terminate the service to the client early or refuse or be unable to provide further coaching sessions to the client. In such a circumstance the client will be given reasonable notice of termination by Sorcha where practicable and will be refunded any advance payments made for coaching sessions not yet provided.

17. ARBITRATION CLAUSE:
If you have any complaint or should any issue arise in the use of the Site or Sorcha Isibeal Coaching’s Courses, Membership, Coaching Services, and/or Products, please contact us directly first by emailing Sorcha at info@sorcha-lifecoach.co.uk.

However, if we are unable to amicably resolve your dispute in that manner, you agree that you and Sorcha Isibeal Coaching shall submit your dispute to binding arbitration with the Arbitration Act 1996 in England and Wales and Northern Ireland, before an arbitrator that is mutually agreed upon, in accordance with the Arbitration Act 1996 rules.

By agreeing to this term, you hereby agree and understand that you’re waiving your right to a jury trial in court, which would otherwise be available to you if not for this Arbitration Clause. Should any arbitration hearing need to be held, it shall be held within 50 miles of Brighton, UK.

If the arbitrator issues an award and a judgment is made, the judgment will be binding and will be entered in court within 50 miles of Brighton. The only award that can be issued to you is a refund of any payment made to Sorcha Isibeal Coaching for the applicable Product or Service. You are not permitted to seek additional damages, including consequential or punitive damages.

18. Consent to Governing Law:
These Terms & Conditions, and any dispute arising out of it, shall be governed by the UK laws.

19. Consent to Service:
You hereby irrevocably agree that process may be served on you in any manner authorized by the UK laws for such persons, and you waive any objection which you might otherwise have to service of process under the laws of the UK laws.

20. Payment & Purchases:
When you Purchase or Download one of our Courses, Services, and Products from us or the Site, you may pay by PayPal or Stripe. By doing so, you give Sorcha Isibeal Coaching permission to automatically charge your credit card for payment. You will receive an electronic receipt following your Purchase, which you should retain for your records.

If you elect the installment or “pay over time” option at checkout, you agree that Sorcha Isibeal Coaching has permission to automatically charge, without checking with you before each installment transaction is charged, the amount due on the date(s) agreed upon at checkout.

If your payment method fails or is otherwise declined, you will be removed from, or canceled from having access to, our Courses, Services, and Products. Please note, in the event your payment method is declined at any time, you are still responsible for the full cost of your Purchase.

We do not accept any chargeback threats (real or threatened). If any chargebacks are placed on a Purchase or Download of our Courses, Services, and Products, we will report said incident to the major credit reporting agencies. Doing so could have a negative impact on your credit report and/or credit score. Should we need to do so and you would like to have this report removed from your credit report, please contact us to arrange for payment owed. Once payment owed is received, we will make the appropriate reports to the credit agencies.

Payment processing companies may have different privacy policies and practices than we do. We are not responsible for the policies of the payment processing companies. As with any online purchase, there are circumstances beyond our control which may compromise your credit card or payment method. We are not liable or responsible for any of those circumstances.

You hereby release us from any and all damages related to your payment or use of our payment processing companies in which you incur and further agree not to assert any claims against us or them for any damages which arise from your Purchase or use of our Site and its Content.

21. Limitation of Liability:
Sorcha Isibeal Coaching is not responsible or liable in any way for any and all damages you receive directly or indirectly from your use, Purchase, or Download from our Site, Courses, Coaching Services, and/or Products. We do not assume liability for damages, injuries, harm, death, misuse of (or failure to properly use) information or documents, due to any act, or failure to act, by you. IN NO EVENT SHALL WE BE LIABLE TO YOU FOR ANY INDIRECT, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES.

22. Defense & Indemnification
You shall, at all times, indemnify, defend, and hold harmless Sorcha Isibeal Coaching, Sorcha, and all of our shareholders, officers, members, affiliates, contractors, subcontractors, directors, assignees, employees, and licensees from and against all losses, damages, injuries, delays, deaths, lost profits, and expenses arising out of any proceeding (a) brought by either a third-party or by Sorcha Isibeal Coaching and Sorcha (b) arising out of your breach of your obligations, representations, warranties, or covenants under these Terms & Conditions or the Privacy Policy; and (c) arising out of any alleged breach or negligence said to have been committed by us.

23. Termination of Your Use
At our sole discretion, we are permitted to terminate your use or access to the Site, Courses, Services, and/or Products, and Purchases/Downloads if you abuse, violate, or breach any of these Terms & Conditions, Privacy Policy, Disclaimer, or any other terms to which you have agreed to.

24. Entire Agreement
These Terms & Conditions, our Privacy Policy and Disclaimer, constitute the entire agreement between you and us with respect to the Site, Courses, Services, and/or Products, and they supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and us with respect to the Site, Courses, Services, and/or Products.

25. Severability
The provisions of these Terms & Conditions are severable, and the invalidity or unenforceability of any provision shall not affect the validity and enforceability of any other provision herein. If any paragraph, section, subsection, sentence, or clause of these Terms & Conditions are rendered illegal, invalid, or unenforceable, such illegality, invalidity, or unenforceability shall have no affect on these Terms & Conditions as a whole or on any other paragraph, section, subsection, sentence, or clause herein.

Coaching Program Disclaimer:

For legal purposes, you understand that coaching is currently an unregulated industry and that your Coach is not “licensed “ by any UK body even though the sessions may take place in the UK.

I understand that the use of technology is not always secure and I accept the risks of confidentiality in the use of email, text, phone, Skype and other technology.

Coaching Program Terms & Conditions:

The coaching schedule will be arranged between Sorcha and the client and can be booked up to 6 months in advance. Sorcha will recommend the frequency of coaching sessions based on a professional assessment of the client’s requirements. This recommendation, or plan, is not binding and may be altered and adjusted throughout the coaching journey by mutual agreement, in accordance with the terms set out in this agreement.

The number of coaching sessions will either be 8 weeks or 6 months on a weekly basis, this will be agreed at the start of the coaching program.

In return for the fees payable by the client (or by a third party on their behalf), Sorcha agrees to provide the service as described below and in accordance with the terms and conditions set out below. The client agrees to pay fees for the service on the terms and conditions set out below (in situations where a third party pays the fees, the third party counts as an agent acting on behalf of the client).

The date that the first coaching session takes place shall be deemed to be the start date for the service. Where any client is unhappy with any of the terms and conditions they can contact Sorcha at info@sorcha-lifecoach.co.uk to discuss any concerns and see if they can be resolved before the first coaching session. Participation by any individual in the first coaching session constitutes acceptance of these terms and conditions.

Format of Sessions:

The 1 to 1 coaching sessions will be via Zoom/Teams, it is your responsibility to turn up on time as well as Sorcha. Each session you will receive a personalised workbook for you to complete. You do not have to complete these, however they are important to your success in getting the results you want.

Payments:

In accordance with Sorcha’s current fee for the coaching programs, the payment will be paid in advance before the first session has started. Sorcha will confirm the fees in writing, usually by email.

The date and time of the first session and any subsequent session will be agreed between Sorcha and the client by phone or email and confirmed by Sorcha by email or letter.

Sessions can only be rearranged in accordance with the section in these terms and conditions headed “Rearranging Sessions”.

Payment Terms

Fees can be paid online by debit or credit card using the Paypal/Stripe payments systems. Where receipts are requested by the client, they will be sent by e-mail unless otherwise requested.

Fees are payable in advance of the coaching program unless payment plan agreed. Where payment has not been received by Sorcha in advance of the coaching program is not obliged to provide the session.

Where payment is required on receipt of invoice rather than in advance, a charge may be levied for late payment.

When you Purchase the Coaching program from Sorcha or the Site, you may pay by PayPal or Stripe. By doing so, you give Sorcha Isibeal Coaching permission to automatically charge your credit card for payment. You will receive an electronic receipt following your Purchase, which you should retain for your records. In Between Sessions

Sorcha may assign the client tasks or exercises to complete between coaching sessions. There is no obligation on the client to complete these items of ‘homework’, but not doing so may slow the client’s progress in gaining improved quality of life or achieving desired business or personal outcomes.

The client may contact Sorcha by phone or e-mail between sessions to seek clarification regarding anything arising from a coaching session or for administrative purposes (e.g. where a client needs to rearrange a coaching session). There is also support messages available if the client is needing help in between sessions.

Re-arranging sessions

If a client needs to rearrange a coaching session, they should provide at least 24 hours notice. No refunds will be given to clients for unused coaching sessions unless 24 hours notice has been given. In exceptional circumstances Sorcha may need to rearrange a coaching session. In those instances she will also give the client 24 hours notice where practical.

Confidentiality

Personal information or business information supplied by clients in coaching sessions will be treated as confidential. It will not be disclosed to a third party without the client’s prior permission, save where required by law or where action might be necessary to prevent harm to the client or someone else.

Early Termination

Responsibilities

Sorcha will seek to enable the client to improve their quality of life or level of personal success and to achieve their desired outcomes. Remarkable results can be achieved where clients follow a clear plan in a committed way. However, the client has sole responsibility for taking important decisions in their life or business. Sorcha has no liability for any loss incurred by any client, whether financial or otherwise, following commencement of coaching sessions, or for any perceived failure by the client, whether justified or otherwise, to achieve a material improvement in quality of life or business or to achieve their desired outcomes or goals.

Governing Law

This contract is governed by the law of England whose courts have exclusive jurisdiction in relation to any dispute, disagreement, proceedings or legal claim of any nature relating to the service provided or the contract.
